ভূমি অপরাধ প্রতিরোধ ও প্রতিকার আইন মতামতের জন্য অবমুক্ত - ভূমিমন্ত্রী

(ঢাকা, বৃহস্পতিবার, ২০ জানুয়ারি ২০২২) ভূমিমন্ত্রী সাইফুজ্জামান চৌধুরী বলেছেন, আজ থেকে ভূমি মন্ত্রণালয়ের ওয়েবসাইটে ‘ভূমি অপরাধ প্রতিরোধ ও প্রতিকার আইন, ২০২১’-এর খসড়া সব অংশীজনের মতামতের জন্য প্রকাশ করা হয়েছে।

আজ রাজধানীর ওসমানী স্মৃতি মিলনায়তনে অনুষ্ঠিত ‘জেলা প্রশাসক সম্মেলন ২০২২’-এ ভূমি মন্ত্রণালয় সম্পর্কিত কার্য অধিবেশনে প্রধান অতিথি হিসেবে জেলা প্রশাসকদের উদ্দেশে বক্তব্য প্রদানকালে ভূমিমন্ত্রী সাইফুজ্জামান চৌধুরী এ কথা বলেন। মন্ত্রিপরিষদ সচিব খন্দকার আনোয়ারুল ইসলাম-এর সভাপতিত্বে অনুষ্ঠিত ভূমি মন্ত্রণালয় সংশ্লিষ্ট আজকের কার্য অধিবেশনে ভূমি সচিব মোঃ মোস্তাফিজুর রহমান পিএএ এবং ভূমি সংস্কার বোর্ডের চেয়ারম্যান সোলেমান খান-সহ মন্ত্রিপরিষদ বিভাগ এবং ভূমি মন্ত্রণালয় ও এর আওতাধীন দপ্তরসমূহের ঊর্ধ্বতন কর্মকর্তারা উপস্থিত ছিলেন।

সাইফুজ্জামান চৌধুরী বলেন, অবৈধ ভূমি দখলকে ফৌজদারি অপরাধের আওতায় এনে ‘ভূমি অপরাধ প্রতিরোধ ও প্রতিকার আইন, ২০২১-এর খসড়া প্রস্তুত করা হয়েছে। ভূমি দস্যুতা রোধে এই আইন কার্যকর ভূমিকা রাখবে বলে ভূমিমন্ত্রী মন্তব্য করেন। তিনি আরও জানান, কৃষিজমি সুরক্ষা, খাদ্য নিরাপত্তা, জলবায়ু পরিবর্তনের ক্ষতিকর প্রভাব হ্রাসের উদ্দেশ্যে করা ‘ভূমি ব্যবহার আইন ২০২১’-এর খসড়া তৈরিও প্রায় শেষের দিকে।

ভূমিমন্ত্রী এ সময় জেলা প্রশাসকদের খাস জমি উদ্ধার এবং খাদ্য নিরাপত্তায় তিন ফসলী জমির সুরক্ষা নিশ্চিত করার জন্য নির্দেশ দেন। এক স্থানে বিভিন্ন দপ্তরের জন্য ঊর্ধ্বমুখী সমন্বিত সরকারি অফিস করার ব্যাপারে মাননীয় প্রধানমন্ত্রীর অনুশাসনটি ভূমিমন্ত্রী এসময় পুনর্ব্যক্ত করেন।

সাইফুজ্জামান চৌধুরী আরও বলেন ভূমি অধিগ্রহণ মামলায় (এলএ কেস) মোক্তারনামা (পাওয়ার অফ এটর্নি) ব্যবস্থা বাতিল করার ব্যাপারটি বিবেচনাধীন আছে। ভূমিমন্ত্রী এই প্রসঙ্গে বলেন, অধিগ্রহণ প্রক্রিয়া ও ক্ষতিপূরণ প্রদানের সময় পাওয়ার অফ এটর্নির মাধ্যমে ব্যাপক দুর্নীতি হয়। বিশেষত গ্রামাঞ্চলের সাধারণ মানুষ এটার মাধ্যমে অসাধু ব্যক্তির দ্বারা প্রতিনিয়ত প্রতারণা ও হয়রানির শিকার হচ্ছেন। এজন্য, বিশেষ ক্ষেত্র ব্যতীত, সাধারণভাবে এলএ কেসে পাওয়ার অফ এটর্নি বন্ধ করার বিষয়টি বিবেচনাধীন আছে।

ভূমিমন্ত্রী জানান এই বিবেচনাধীন ব্যবস্থায়, বিশেষ ক্ষেত্র, যেমন বিদেশে বসবাসরত ব্যক্তিরা বাংলাদেশের দূতাবাসের মাধ্যমে পাওয়ার অফ এটর্নি দিতে পারবেন। এছাড়া গুরুতর অসুস্থ ব্যক্তির ক্ষেত্রে এবং অন্যান্য প্রযোজ্য ক্ষেত্রে সংশ্লিষ্ট জেলা প্রশাসকের কাছে আবেদন করে পাওয়ার অফ এটর্নি দেওয়া যাবে। মন্ত্রী বলেন সবার মতামতের ভিত্তিতেই এই বিষয়ে চূড়ান্ত সিদ্ধান্ত নেওয়া হবে।

সাইফুজ্জামান চৌধুরী জানান, ভূমিসেবা আরও সহজ করতে ই-রেজিস্ট্রেশন এবং ই-মিউটেশন-এর ইন্টিগ্রেশনের উদ্যোগ নেওয়া হয়েছে। এরফলে জমির হাতবদলে স্বয়ংক্রিয়ভাবে নামজারি হয়ে যাবে। এছাড়া অত্যাধুনিক প্রযুক্তির সাহায্যে বাংলাদেশ ডিজিটাল সার্ভে (বিডিএস) শুরু হবে দ্রুত। তিনি এসময় আশা প্রকাশ করেন, বিডিএস বাংলাদেশের সর্বশেষ 'ক্যাডাস্ট্রাল জরিপ' হবে। এর বাস্তবায়ন হলে জমি হাত বদলে স্বয়ংক্রিয়ভাবে খতিয়ান ও ম্যাপ প্রস্তুত হয়ে যাবে, ফলে যুগযুগ চলে আসা ধরে জরিপের হয়রানি থেকে দেশের মানুষ রক্ষা পাবে।

ভূমিমন্ত্রী জেলা প্রশাসকদের উদ্দেশে বক্তব্যের শেষে বলেন, মন্ত্রণালয় পর্যায়ে, তথা নীতিনির্ধারণী পর্যায়ে আমরা ভূমিসেবা ডিজিটালাইজেশন ও আইন-বিধি যুগোপযোগীকরণের আজ করে যাচ্ছি। মাঠ পর্যায়ে এসব দক্ষতা, স্বচ্ছতা ও জবাবদিহির মাধ্যমে প্রয়োগের মাধ্যমে দেশের নাগরিকদের ভূমিসেবা দেওয়ার মূল দায়িত্ব আপনাদের। ভূমি-সেবায় নাগরিক অসন্তুষ্টিকে নাগরিক সন্তুষ্টিতে রূপান্তরে আপনাদের ভূমিকাই সবচেয়ে বেশি। জেলা প্রশাসক বা কালেক্টর হিসেবে আপনাদের কার্যকর উদ্যোগ ছাড়া নাগরিক অসন্তুষ্টি দূর করা অসম্ভব। এ ব্যাপারে ভূমি মন্ত্রণালয় আপনাদেরকে সকল ধরণের সহায়তা করবে। ভূমি মন্ত্রণালয় এবং এর আওতাভুক্ত দপ্তরসমূহ সেবাধর্মী প্রতিষ্ঠান উল্লেখ করে মন্ত্রী আরও বলেন, সেবার মান বৃদ্ধি করার জন্য গতানুগতিক চিন্তাধারার বাইরে এসে কাজ করতে হবে।

এ অধিবেশনে জেলা প্রশাসকগণ বিভিন্ন বিষয়ে তাঁদের মতামত ব্যক্ত করেন ও প্রশ্ন করেন। খাসজমি, নামজারি, হাট ও বাজার, ভূমি অফিস নির্মাণ, জলমহাল, পার্বত্য অঞ্চলের ভূমি ব্যবস্থাপনা, কোর্ট অফ ওয়ার্ডস, ভূমি সংশ্লিষ্ট জনবল ও প্রশিক্ষণ, ডিজিটালাইজেশন, ভূমি ব্যবস্থাপনায় উদ্ভাবন-সহ ভূমি সংশ্লিষ্ট নানা বিষয় উঠে আসে কার্য অধিবেশনের আলোচনায়।

উল্লেখ্য, ভূমি রেজিস্ট্রেশন ও ভূমি জরিপ ব্যতীত, ভূমি রাজস্ব ও ভূমি ব্যবস্থাপনা সহ ভূমি সংক্রান্ত অন্যান্য সকল সেবা প্রদানে কালেক্টর হিসেবে জেলা পর্যায়ে দায়িত্বপ্রাপ্ত কর্মকর্তা জেলা প্রশাসক।

অধিবেশন শেষে ভূমিমন্ত্রী এক সাংবাদিক সম্মেলনে অংশগ্রহণ করেন এবং জেলা প্রশাসকদের উদ্দেশে তাঁর দেওয়া নির্দেশনার ব্যাপারে সাংবাদিকদের বিভিন্ন প্রশ্নের উত্তর দেন।

‘Land Crime Prevention and Redress Act, 2021’ is open to opinion - Land Minister

Land Minister Saifuzzaman Chowdhury has said that today the draft of ‘Land Crime Prevention and Redress Act, 2021’ has been published on the land ministry website for the opinion of all stakeholders.

Land Minister Saifuzzaman Chowdhury said this while addressing the Deputy Commissioners in the DC Conference 2022 held in Osmani Memorial Auditorium in the capital today as the chief guest at the working session of the Land Ministry. Cabinet Secretary Khandker Anwarul Islam chaired the session. Land Secretary Mohammad Mustafizur Rahman PAA, Chairman of the Land Reform Board Suleman Khan, and senior officials of the Cabinet Division, Ministry of Land, and its departments were present at the session.

Saifuzzaman Chowdhury said that the draft of ‘Land Crime Prevention and Redress Act, 2021’ has been drafted, making illegal land grabbing a criminal offense. Land Minister opined that this law will play an important role in preventing land grabbing. He also said that the draft of ‘Land Uses Act 2021’ for farmland protection, food security, and to reduce the harmful effects of climate change.

The Land Minister directed DCs to rescue the Khas (government-owned) land and to ensure three-field arable land protection for food security. The Land Minister reiterated the Prime Minister’s instruction to construct combined highrise office buildings for different government offices in one place.

Saifuzzaman Chowdhury also said the Power of Attorney system in the Land Acquisition case (LA Case) is under consideration to be rescinded in the general case. Widespread corruption is taking place through Power of Attorney during the acquisition process and payment of compensation - The land minister said. Especially the common people in the rural areas are regularly being deceived and harassed by dishonest people. For this reason, except for special matters, revoking of Power of Attorney in the LA case is under consideration.

The Land Minister said that, under this considered system, in special cases, such as those living abroad, can give Power of Attorney through the embassies of Bangladesh abroad. In addition, Power of Attorney can also be given in case of a critically ill person and other applicable cases by applying to the DC. The minister said a final decision in this regard will be taken based on everyone’s opinion.

Besides, with the help of sophisticated technology, Bangladesh Digital Survey (BDS) will set out very soon. He hoped that BDS will be the last ‘Cadastral survey’. The Record of Rights and Map will automatically be prepared in the case of land transfer after this survey; As a result, people of the country will survive from the harassment of the survey.

The Land Minister said at the end, at the ministry level, as well as at the policy-making level, we are working on the digitalization of land services and updating the laws and regulations. It is your responsibility to provide land services to the citizens of the country through efficiency, transparency, and accountability at the field level. Your role in converting citizen dissatisfaction into satisfaction in the land service is imperative. As a Deputy Commissioner and Collector, it is impossible to remove citizen dissatisfaction without your effective initiative. The Ministry of Land will provide all support to you in this regard. Referring to the Ministry of Land and its departments as service-providing agencies, the minister also said that, to increase the quality of service, one has to come out of the box.

In this session, the Deputy Commissioners expressed their views and asked questions. Various issues related to land management, including mutation, Haat and Bazar, land office construction, water bodies, land management, the court of wards, human resource and training, digitalization, innovation in land management have been discussed in the session.

It is to be noted that the Deputy Commissioner as a Collector is the designated officer at the district level to provide all related services, including land revenue and land management, except for land registration and land survey.

After the session, the Land Minister met the press and answered the questions of journos regarding the directions he has given to the Deputy Commissioners.
